City Commissioner Michelle Spence-Jones announced on Tuesday that she plans to sue State Attorney Katherine Fernandez Rundle for violation of her civil rights. Specifically, Spence-Jones says her lawyers will go after the state attorney on the grounds of prosecutorial and investigatory misconduct. Spence-Jones has employed the services of the New York-based law firm of Emery Celli Brinckerhoff & Abady to represent her the firm that also represents former Duke University lacrosse players who were wrongfully accused of rape in 2006 and are now suing North Carolina police officers. Spence-Jones alledges that her civil rights were violated when she was being prosecuted in two separate public corruption cases. She returned to office in August 2011. Spence-Jones was unable to comment more specifically on the case but has agreed to talk with The Miami Times as soon as her lawyers permit. Rundles office, according to spokesperson Ed Griffith, cannot comment on ongoing litigation. By D. Kevin McNeir kmcneir@miamitimesonline.com
