New judge to rule on third term for Spence-Jones

Miami-Dade Circuit Court Judge Marc Schumacher, chosen randomly last week to take over for Judge Jorge Cueto who disqualified himself, has scheduled Wed., March 24 for a status hearing over whether City Commissioner Michelle Spence-Jones can run for a third term. The hearing will take place at 1 p.m. Two weeks ago, Cueto had ruled that Spence-Jones was term limited and could not run for a third term because she was qualified to run, then was elected a second time, as the city charter stipulates. However, one week later Cueto recused himself after Spence-Joness attorney, Bruce Rogow, filed a motion asking that the judge disqualify himself for not informing the parties of his role as a state prosecutor in the 2007 probe involving a Coconut Grove development and Spence-Jones. The development and the investigation both subsequently died. Cueto stepped down but his order that Spence-Jones could not run for a third term stood and will therefore be the subject of the hearing on Wednesday. Miami Times staff report
